The way I see it, there are two entities who could press charges against him for attempted murder: Hannibal Lecter and the state.

Hannibal isn’t going to choose to do that because he clearly wants Will free. That’s why he cleared him of the murders for which he was incarcerated.

The state, in this instance, is the FBI—and they probably think that Will Graham (the Will who never killed all those people) is a lot more valuable on the outside (helping them figure out who the fuck DID kill those people, and framed him). They’re choosing not to press charges because the Chesapeake Ripper is a greater concern at this point.

Will’s credibility is (largely) back and he’s worth more as an ally than rotting in the Baltimore State Hospital for the Criminally Insane.
